Article 1: Organisation

The Company ACCOR, joint stock company with share capital of 680,381,847 Euros, registered with the Trade and Companies Register of EVRY under number B 602 036 444 and having its registered office at 2, rue de la Mare Neuve 91000 EVRY (hereafter called the "Organiser Company") is organising a game that is free and without any purchase obligation named " World Tour accorhotels.com " conducted in ten separate phases, from 1st March 2011 to 31st December midnight on the Website http://www.accorhotels.com (hereafter called the "Game").

The days and times given in these rules are in the Brussels, Copenhagen, Madrid, Paris (UTC+01:00) time zone. No other time zone will be taken into account for taking part in the Game.

All brand names, logos and other distinctive symbols reproduced on the Website stated hereinabove as well as on the sites which can be accessed from this site through hypertext links, are or are deemed to be the exclusive property of their owners and are or are deemed to be protected.

Any unauthorised reproduction of these brand names, logos and symbols constitutes or is deemed to constitute an infringement punishable, in particular, by penalties.

All the software used on the Website given above and those that can be accessed through this site, as well as the texts, comments, illustrations or images reproduced on the site and on those sites that can be accessed through it are or deemed to be protected by copyright and their unauthorised reproduction constitutes or is deemed to constitute an infringement punishable, in particular, by penalties.

Article 2: Participation

The Game, free and with no obligation to purchase, is open to any individual with the exception of the employees and representatives of the Organiser Company, its partners and its sub-contractors, as well as their advisors and members of their family, including the live-in partners and, in general, any company or individual involved, either directly or indirectly, in organizing or in implementing the Game.

Minors are allowed to participate in the Game under the responsibility and with the authorisation of the legal representative who can prove his/her parental authority; age of adulthood is dependent on the laws of their country of residence on the day of participation. The Organiser Company can ask any minor participant to prove that he/she is participating under the responsibility and with the authorisation of the legal representative as given above and, if applicable, disallow any minor participant who cannot prove this and, if required, cancel the prize awarded to this minor.

Article 3: Participation modalities

Two modes of participation in the Game are available, either one of which can be used:

The person eligible for the draw of lots is the one who will have made the reservation. These conditions are cumulative and all of them must be fulfilled in order for the electronic participation to be considered valid. The information given by the participant while making the reservation must be complete and valid on the day of the draw of lots. Participation in the Game is exclusively reserved for individuals. (Persons making a reservation professionally in any hotel of the ACCOR group through the Website or through an associated mobile service or benefiting from contracted rates are not eligible)

Participation in the Game is automatic at the time of validating the reservation. Persons who do not want to take part in this game at the time of making their reservation can send an e-mail stating so to unsubscribe.prize@accor.com.

2. By post

The participant must send his request for participation on plain paper stating his last name, first name, date of birth, telephone number, complete residential address (street no., street name, postal code, city and country) and the e-mail address to the following address:

The same person can participate in each of the ten phases of the Game listed in article 4 hereinbelow of these rules, given that:

Consequently, the electronic participations sent before 1st March 2011 and after 31 December 2011 will not be taken into account for any of the phases of the Game.

Requests for participation by post must be sent before the following dates from 1st March 2011 onwards. The participation forms will not be taken into account after these dates (postal stamp as proof):

Any incomplete participation form, containing false or wrong information or declarations, or not in compliance of the terms of these rules, will be considered as void and will automatically result in the disqualification of the concerned participant and, if applicable, cancellation of the awarded prize.

Article 4: Phases of the Game

The Game comprises of ten separate phases:

The participants can take part in one or several phases of the Game by registering themselves in compliance with the terms of article 3 hereinabove of these rules.

For each phase of the Game, a draw of lots is organised in compliance with article 6 hereinbelow of these rules.

The winners of each phase of the Game are drawn by lots and are awarded the prizes indicated in article 5 hereinbelow of these rules.

Article 5: Prizes

The Organiser Company has the following 110 (one hundred and ten) prizes at stake:

  • ten (10) identical world tours for two persons with a market value from 3000 Euros onwards, with each comprising plane tickets in economy class with first departure from one of the following ten stop-over cities nearest to the winner's place of residence:
    • Paris (France)
    • London (Great Britain)
    • New-York (United States of America)
    • Rio de Janeiro (Brazil)
    • Madrid (Spain)
    • Bangkok (Thailand)
    • Beijing (People's Republic of China)
    • Sydney (Australia)
    • Berlin (Germany)
    • Rome (Italy).

    The duration of each world tour varies between 30 and 40 days depending on the place of departure. The ten stop-over cities visited during this world tour are Paris (France), London (Great Britain), New-York (United States of America), Rio de Janeiro (Brazil), Madrid (Spain), Bangkok (Thailand), Beijing (People's Republic of China), Sydney (Australia), Berlin (Germany), Rome (Italy). The stop-over order in these cities will be determined by the Organiser Company. This world tour comprises plane tickets in economy class, transfer to the departure airport that is nearest to the winner's place of residence and lodging. Transfers between the airports and the lodging places are not included in the prize. Lodgings include only the room nights. The number of room nights of stay at each stop-over as fixed by the Organiser Company varies between two and four. Hotels for the lodging will be selected by the Organiser Company depending on the availability. Any extras consumed by the winner will be to his/her charge. The list of participating hotels for each of the ten cities is identical to the list given hereinbelow for the prizes pertaining to the won hotel stays.

  • One Hundred (100) stays for two persons for four nights in one of the following ten stop-over cities:

    The winners will choose their destinations and their dates (taking into account the availability as indicated in these rules) and ACCOR will be responsible for selecting a hotel depending on the developments in these availabilities). Any extras consumed by the winner will be to his/her charge. The rates given for all the hotels in each city are rack rates, without restrictions and starting from:

    For each of the ten phases of the Game, eleven winners will be drawn by lots and the above mentioned prizes will be awarded as follows:

    the first winner (person first to be drawn by lot) will be awarded one of the ten world tours for two persons described above.

    the next ten winners (the ten persons drawn by lots after the first winner) will each of them be awarded one of the hundred stays for two persons described above in the hotel of their choice from the hotels listed hereinabove.

    The market value of the prizes indicated in this Article is as noted on the day that these rules were formulated. Taking into consideration that this game will last over ten months as described in these rules, this value cannot be guaranteed over this entire period.

    Should this value be subsequently modified due to, for example, an increase in the cost of fuel resulting in an increase in the price of the plane tickets, or for any other reason not attributable to the Organiser Company or not on account of its actions, the prizes will still be awarded in compliance with the description given in these rules but the Organiser Company will under no circumstances be held liable for this change in the market value, whatever it may be.

    The elements that will be required for the prize to be availed will be sent to the concerned winner by e-mail at the e-mail address that will have been given by the winner at the time of participating in the Game.

    If the e-mail address and/or the telephone number are/is wrong and the Organiser Company is not able to send the elements that will be required for the prize to be availed, the said prize will be considered to be completely abandoned by the concerned winner unless he/she sends a claim for it to the Organiser Company within six (6) months after the draw of lots naming him/her as a winner.

    Each winner will be able to transfer his prize to a third party, given that each prize must necessarily be availed within twelve (12) months from the date of the draw of lots in case of the world tour and six (6) months for the hotel stays. The winners should alert the Organiser Company about wanting to avail the won prize and make the necessary reservations with the organiser company at least sixty (60) days before the departure date in case of the world tours and at least thirty (30) days before the departure date in case of the hotel stays.

    The prizes cannot be reimbursed in cash or against anything else of any nature whatsoever. However, in case of force majeure or if the circumstances so require, the Organiser Company reserves the right to replace the announced prizes with prizes of value equivalent to the market value indicated in these rules.

    The Organiser Company will not be held liable for the delays, losses, damages and deteriorations affecting the elements required for the prizes to be availed or their dispatch, or even the illegibility of the seals, which would be on account of the service provider responsible for the transport. It does not accept any liability with regard to the state of the elements indicated above on the delivery of the post containing them. Without prejudice to any legal action and its option to cancel the participant's registration, the Organiser Company is not bound to send the elements required for the prizes to be availed by the winner who will not have correctly entered his/her contact details at the time of his/her participation, who may have clearly succeeded in distorting the results of a phase of the Game by any means or who is not in compliance with these rules.

    The Organiser Company will not be held liable for any prejudice that may arise by the acceptance and/or the availing of the prize.

Article 6: Name and information of the winners

The winners of each phase of the Game are named by draw of lots conducted by the SCP Pascal ROBERT and Mayeul ROBERT, Associate Bailiffs, 16, rue Vignon 75009 PARIS (France), with the help of a random draw computer software without number repetition, based on the following timetable:

  • Draw of lots of the participants in the first phase on 13 April 2011
  • Draw of lots of the participants in the second phase on 11 May 2011
  • Draw of lots of the participants in the third phase on 15 June 2011
  • Draw of lots of the participants in the fourth phase on 13 July 2011
  • Draw of lots of the participants in the fifth phase on 10 August 2011
  • Draw of lots of the participants in the sixth phase on 14 September 2011
  • Draw of lots of the participants in the seventh phase on 12 October 2011
  • Draw of lots of the participants in the eighth phase on 16 November 2011
  • Draw of lots of the participants in the ninth phase on 14 December 2011
  • Draw of lots of the participants in the tenth phase on 11 January 2012

Eleven winners will be named at each draw of lots and the winning order will determine the awarding of the prizes at stake.

The communes and the countries of residence of the winners will be displayed on the Website of the Organiser Company in compliance with the terms of Article 12 hereinunder of these rules.

The winners will be informed by the Organiser Company about the results and the prize that they have won by e-mail and/or by telephone at the address and/or the number indicated at the time of their registration, containing the elements that will enable them to avail the won prize as is given in Article 5 of these rules.

The winners authorise the Organiser Company to conduct any verifications with regard to their identity and their addresses (postal or/and electronic). Any false information about the identity or addresses will result in the cancellation of the awarded prize and all entries of the winner in different phases of the Game.

By accepting their prize, the winners authorise the Organiser Company to use their last name, first name, in any promotional event associated with this Game such that this use does not result in any compensation other than the prize won.

Article 7: Legal filing and consultation of these rules

The rules are filed with the SCP Pascal ROBERT and Mayeul ROBERT, Associate Bailiffs, 16, rue Vignon 75009 PARIS (France).

The rules of the Game are sent, free of charge, to any person who requests for them. This request must be made in writing and sent by post, before the closure date of the Game, with the postal stamp acting as proof, to the following address:

Postal expenses towards the request for rules will be reimbursed on simple demand in line with the modalities of Article 8 hereinunder of these rules.

Article 8: Reimbursements

Since the Game is free, any participant, on demand, can be reimbursed for the connection (electronic participation) or postage (postal participation) expenses that he/she incurred for taking part in the Game in compliance with the terms of these rules.

The request for reimbursement must be sent only by post latest 30 days after the closure date of the Game, with the postal stamp acting as proof, to the following address:

The reimbursement will be made by bank transfer and credited to the participant's account provided that in his/her mail, he/she has clearly mentioned his/her last name, first name, full address (street and street number, postal code, city and country), phase(s) of the Game in which he/she participated and has attached a photocopy to the mail of his/her identity card, his/her RIB (official slip giving full bank account details) and in addition, in case of the electronic participations, copy(ies) of the detailed telephone bill(s) specifying the date(s) and time(s) of participation.

Requests of reimbursements that are incomplete or non-compliant with the stipulations of this Article will not be honoured.

Reimbursement of the postage expenses in case of postal participations will be made on the basis of the second-class "letter" rate in force, since these rules do not require the participants, under any circumstances, to send their request for participation by registered post or by any other means that incur a cost higher than the second-class "letter" rate in force.

Reimbursement of connection expenses in case of electronic participations will be on seeing the copy of the detailed telephone bill attached to the reimbursement request letter, given that the participants who did not bear additional connection or communication cost in order to participate in the Game (holders of a flat-rate subscription, users of cybercâble, etc.) will not be able to get any reimbursement.

Under all circumstances, the reimbursement is restricted to one reimbursement for each household (same family name, same address) and for each phase of the Game.

When these conditions stated above are fulfilled, the expenses incurred by the participant for the stamp needed to send the reimbursement request will be reimbursed to him/her under the same conditions as that of the reimbursement of postage expenses of the participation letter, provided that the participant requests for the same in his/her request letter for reimbursement of the participation expenses.

Article 9: Disputes, liabilities and force majeure

Entry into the Game through Internet implies the knowledge and acceptance of the characteristics and the scope of the Internet, especially with regard to the technical behaviour, response time to view, query or transfer information, risks of interruption and, in general, the risks inherent to any connection and transmission, lack of protection of some data against possible misuse or piracy and the risks of contamination by any viruses present on the network.

The Organiser Company will not be held liable in case of wrong use or incident associated with using a computer, accessing the Internet, maintenance or malfunctioning of the Game servers, telephone line or any other technical connection, and sending the Game registration forms to a wrong or incomplete address.

The Organiser Company specifies that the use of hypertext links can lead the participant to other Websites, independent of the Organiser Company, which, as a result, will not be held liable for the activities of these third party websites.

Unless there is clear prior approval by the Organiser Company, no participant is authorised to create a hypertext link between the website of the Organiser Company and any other website, or it will be held liable for it.

The Organiser Company cannot be held liable for the poor functioning of the website(s) and/or of the Game for a given browser.

The Organiser Company does not guarantee that the websites and/or the Game will operate without interruption or that there will be no computer errors of any kind, nor that the observed defects will be corrected. If there is a technical malfunction in the Game, the Organiser Company reserves the right, if needed, to invalidate and/or cancel the phase of the Game during which the said malfunction took place. No claim will be accepted on this account.

The Organiser Company cannot be held liable if it does not receive a participant's registration data, in whole or in part, for any reason not be attributable to it (for example, a problem of connection of the participant to the Internet, fleeting failure of the Organiser Company's servers, etc.) or if it receives it but it is illegible or impossible to process.

Any information given by a winner, especially his/her contact details, will be considered as void and will not be taken into account if it is wrong.

The Organiser Company will not be held liable for a prejudice of any kind (personal, physical, material, financial or any other) that takes place while participating in the Game.

The Organiser Company's liability will not be imposed:

The Organiser Company will not be held liable for any direct or indirect damage resulting from an interruption, malfunction of any kind, suspension or end of the Game, and this for any reason whatsoever or even for any direct or indirect damage, in any manner whatsoever, as a result of a connection made to the Website of the Organiser Company.

Every participant is responsible for taking all appropriate measures to protect his/her own data and/or software stored in his/her computer hardware against any harm.

The participants are fully responsible for the connection of any person to the Organiser Company's Website and for participating in the game.

The Organiser Company will not be held liable for any delayed arrival or non-arrival of a participation letter, which will preclude the participation of its author in the Game.

The Organiser Company will not be held liable if, in case of a force majeure even or an event outside its control, the Game has to be modified, shortened or cancelled.

Under all circumstances, the Organiser Company reserves the option to extend the period of participation. Addendums or, in the case of force majeure, amendments may possibly be made to these rules during the course of the Game.

These addendums and amendments will be considered as appendices to these rules and filed at the Office of the Bailiffs wherein these rules were filed.

The Organiser Company may rely, in particular for evidence, on any act, event or omission, programmes, data, files, records, operations and other items (such as the tracking reports and other reports) in their original state or in computer or electronic media prepared, received or retained directly or indirectly by the Organiser Company, including its information systems, in connection with the use of its Website.

Participants undertake not to challenge these elements on the basis of any statutory provision whatsoever and which would provide that certain documents must be written and / or signed by the parties to constitute proof.

Thus, these elements constitute proof and, if produced as evidence by the Organiser Company in any litigation or otherwise, they will be admissible, valid and enforceable between the parties in the same way, under the same conditions and with the same value as any written and / or signed document.

The Organiser Company reserves the right to exclude any person from taking part in the Game who is disturbing the process.

The Organiser Company reserves the option to use any recourse and in particular to sue anyone who would have cheated, tricked, rigged or disturbed the operations described in these rules, or would have attempted to do so.

Any participant considered by the Organiser Company to have disturbed the Game in any of the ways stated above, will be rightfully stripped of any right to get any prize.

The Organiser Company reserves the right, especially in case of pressing reason, to shorten, extend or to cancel the Game and/or one or several of its phases, if the circumstances so demand. It will not be held liable on this account.

These changes will however be informed in advance by all suitable means, especially through the Organiser Company's Website.

The Organiser Company reserves the possibility to momentarily suspend the possibility of taking part in the Game or the Game itself if it, or its future service provider of the lodging, can no longer ensure the continuity of service necessary for playing the Game and/or the safety of personal information of the participants.

The Organiser Company can always terminate all or part of the Game, in case of force majeure, fortuitous scenarios or exceptional circumstances (fire, flood, natural catastrophe, malicious intrusion in the computer system, strike; questioning the financial and technical stability of the Game, break-up and blockage of the telecommunication networks, virus against which adequate protective measures do not exist, legal or regulatory or public obligations resulting in modifying these rules, or any other force majeure event or fortuitous scenarios as meant under Article 1148 of the Civil code) even resulting on account of its actions (in this case subject to its good faith).

The Game will be cancelled in case of force majeure event and the participants or winners will not have any right to claim any damages on this account.

Article 10: Acceptance of the rules and claims

Participation in the Game implies unconditional acceptance of these rules. By participating, the player certifies that he/she meets all the conditions necessary for participating in the Game and undertakes to comply with the conditions of these rules as well as the laws and regulations applicable to promotional games.

Any dispute or claim must be brought to the attention of the Organiser Company latest by the Game closing date by registered post with acknowledgement of receipt mentioning the complete contact details of its initiator, his/her date of participation in the Game and the reasons and the purpose of his/her dispute or claim.

Any question or difficulty in interpreting these rules will be resolved without appeal by the Organiser Company.

Article 11: Information Technology and Freedom

The nominative information collected as part of the Game will be processed electronically in compliance with the Law on Information Technology and Freedom no. 78-17 dated 6 January 1978.

In compliance with this law, all the participants in the Game with their identification, or their legal representatives if they are minors, have the rights of opposition (article 38 of the law), of access (article 39) and of amendment and deletion (article 40) of their own data available with the Organiser Company.

By these presents, the participants are informed that the nominative data about them may be transmitted to the Organiser Company's commercial partners and that they can oppose this transmission.

The participants authorise the Organiser Company that if they are the winners of any of the prizes described in article 5 hereinabove of these rules, their last names, first names, commune and country of residence can be broadcast on any media, in particular paper or electronic, which lists the winners of the Game who have given their authorisation. They are informed that they can oppose this distribution.

Any request for access, amendment or opposition must be addressed to the Organiser Company, at the following address: Accor – Département Data Privacy – 110 avenue de France – 75210 Paris Cedex 13.

Article 12: Literary and artistic property rights

In compliance with the laws governing the literary and artistic property rights, the reproduction and representation of all or part of the items comprising the Game are strictly prohibited. The cited brand names are brand names registered by their respective owners.

Article 13: Applicable law and competent courts

These rules, in particular with regard to their validity, are governed by the French Laws with regard to their interpretation and execution.

Any dispute that cannot be resolved amicably will be submitted before the competent courts in compliance with the rules of the French Law.
